Performing Rights Licensing

The purpose of the representative licensing activity is to ensure the collection of royalty fees arising from the use of music on behalf of members and to work on increasing licensing revenues in this area. According to the relevant articles of the Law No. 5846 on Intellectual and Artistic Works, a music work generates royalty rights for the rights holder/owner due to its public performance in various forms. In the representative field, these usage types can be categorized as Radio-TV, Public Places (UMK), Live Performance, Concerts and Events, and Digital Licensing.

In the Radio-TV area, in order to monitor royalties arising on behalf of MSG members, radio and television broadcasters in Turkey—including national, regional, local, satellite, and all other categories—are identified, contract invitations are sent, and by signing contracts, the use of MSG’s repertoire is authorized. Royalties generated from these uses are distributed to MSG members. In this regard, legal action is taken against users who do not respond to the contract invitations, based on detections of works used without authorization.

In the Public Places (UMK) area, royalty tracking and collection are carried out for the use of MSG members’ works in all venues where music is broadcast, such as hotels, bars, restaurants, cafes, stores, shopping malls (AVM), transportation companies, gyms, hair salons, and all other possible venues. Users are invited to sign contracts. Currently, licensing activities are being conducted nationwide in Turkey under a Regional Law Office Structure. MSG authorizes a law office and a team in each region to carry out relevant licensing work with the support and coordination of the Licensing Department through field operations.

In the area of Live Performance, Concerts, and Events, organizers responsible for the relevant events are identified, contracts are signed based on annually announced tariffs, and royalty tracking and collection are conducted for works belonging to MSG members that are performed.

Within Digital Licensing, users operating in the digital space—including digital platforms offering music services, audiovisual OTT service providers, simultaneous internet broadcasts of terrestrial transmissions, and applications using music—are licensed according to the type of music usage and the scope of the permission requested.
