Musiki Eseri Sahipleri Grubu Meslek Birliği (MSG) — Personal Data Protection Information
Musiki Eseri Sahipleri Grubu Meslek Birliği (“MSG”) hereby provides the following fundamental information regarding the protection of personal data, in accordance with its disclosure obligation under Article 10 of Law No. 6698 on the Protection of Personal Data (“KVKK”). This Personal Data Protection Notice may be updated at any time by MSG in accordance with changes in applicable legislation.
As Musiki Eseri Sahipleri Grubu Meslek Birliği, we process the personal data we have obtained from our valued members, considering the confidentiality of private life, within the scope of Law No. 6698 on the Protection of Personal Data (“KVKK”), as the Data Controller. The scope and manner of processing by MSG are explained below.
I. How and on What Legal Basis Do We Collect Your Personal Data?
Your personal data include any information and documents, provided to us in written, oral, and/or electronic form during and/or after your membership application, including sensitive personal data such as health information (name, surname, identification details, date of birth, phone number, e-mail, address, IP address, IPI number, social media accounts, education status, region of residence, etc.). These data are processed and stored physically and digitally by MSG based on the consent of our members and the provisions of legislation.
Your personal data are processed and transferred domestically and internationally within the framework of fundamental principles set forth by the KVKK Articles 5 and 6, and the purposes of data processing, primarily within the scope of Law No. 5846 on Intellectual and Artistic Works, the Regulation on Professional Associations and Federations of Authors and Related Rights Holders, MSG’s Internal Regulations, Turkish Penal Code No. 5237, and other relevant legislation, as specified in this “Disclosure Notice.”
MSG collects, processes, shares with third parties, and securely stores your data solely for the purposes stated in this Personal Data Protection Notice to better serve its members and fulfill its legal obligations.
II. For What Purposes Do We Process Your Personal Data?
Your personal data are processed for the following purposes:
- To fulfill the obligations undertaken within the framework of the membership authorization agreement signed with MSG, verify identity information, and record necessary contact details for communication, in accordance with Law No. 5846 and related legislation.
- To carry out activities in line with the purposes defined in the legislation to which MSG is subject, communicate with members regarding contract terms, collections, and distributions, and provide necessary information.
- To perform all procedures required to benefit from membership, and to organize all records and documents serving as a basis for processing electronically (internet/mobile) or on paper.
- To analyze personal data and information statistically in an anonymized way to improve services.
- To provide information about requested services.
- To evaluate member complaints and suggestions related to our services.
- To manage applications and mobile apps.
- To ensure the security of personal data stored by MSG and to transfer data for safeguarding purposes.
- To make backups to prevent data loss.
- To send electronic communications in compliance with legislation.
- To provide information to public authorities upon request or when required by law regarding public safety.
- To comply with legal obligations and other purposes set out in the KVKK.
III. To Whom and For What Purpose Do We Transfer Your Personal Data?
Personal data of our members are shared with third parties only with the consent of the member and are not transferred without their approval.
However, data may be shared with courts and other public authorities due to legal obligations. Additionally, data may be transferred to contracted third parties to provide and monitor services.
Necessary technical and legal measures are taken to prevent rights violations during such data transfers. Nonetheless, MSG is not responsible for breaches occurring under the responsibility of third parties due to their data protection policies.
In line with Articles 8 and 9 of KVKK and the purposes mentioned above, personal data collected within the scope of Articles I and II may be transferred domestically or internationally to accredited institutions, foreign professional associations, legally authorized public institutions, MSG’s affiliates, partner institutions, cloud storage providers, marketing agencies, banks, and other third parties involved in providing services.
IV. How Does MSG Protect Your Personal Data?
Personal data shared with MSG are under MSG’s supervision and control. MSG is responsible as the Data Controller for establishing the necessary organization, taking and adapting technical measures to protect confidentiality and integrity in accordance with applicable legislation. Periodic penetration tests and continuous updates of data processing policies are conducted in line with international and national technical standards.
V. What Are Your Rights as the Data Subject Under Article 11 of KVKK?
As a data subject, you have the right to:
- Learn whether your personal data is processed,
- Request information if your personal data has been processed,
- Learn the purpose of processing and whether data is used accordingly,
- Know third parties to whom your data is transferred domestically or abroad,
- Request correction of incomplete or inaccurate data and notify third parties of the correction,
- Request deletion or destruction of data when processing reasons no longer exist and notify third parties accordingly,
- Object to decisions based solely on automatic data processing that affect you negatively,
- Demand compensation for damages caused by unlawful processing.
VI. How to Exercise Your Rights?
You can exercise your rights by submitting a fully completed application form available at the provided link to Musiki Eseri Sahipleri Grubu Meslek Birliği, Esentepe Mahallesi Haberler Sokak No: 4, Şişli, Istanbul, either in person or by registered mail. MSG will respond free of charge within 30 days, unless a fee is specified by the Personal Data Protection Board.
Applications must include:
- Full name and signature,
- Turkish ID number or foreigner’s ID/passport number,
- Address for notification,
- Contact information (email, phone, fax),
- Clear description of the request.

VII. How Long Are Your Personal Data Processed?
Personal data processed for the purposes stated in this notice will be deleted, destroyed, or anonymized when the processing purpose ceases, in accordance with Article 7/f.1 of KVKK.
VIII. Personal Data Obtained Before the Enforcement Date of KVKK
Personal data lawfully obtained before the enforcement date of April 7, 2016, continue to be processed and retained in compliance with this notice and KVKK.
IX. Cases Where MSG Can Process Personal Data Without Explicit Consent
MSG may process your personal data without explicit consent in the following cases as per Article 5 of KVKK:
- When explicitly provided for in legislation MSG relies on,
- When obtaining consent is impossible due to factual impossibility or invalid in certain cases, and data processing is necessary for the protection of life or physical integrity,
- When required for legal obligations of MSG,
- If data has been made public by you,
- When necessary for establishment, exercise, or protection of a right,
- When required for MSG’s legitimate interests without harming your fundamental rights and freedoms.

Your rights under KVKK are MSG’s obligations. We process your data consciously and will update this page as required by law to reflect any changes. Updates will always be accessible via this page.
